Terms and conditions
Please take your time to carefully read and understand our Booking Terms and Conditions detailed below before booking a trip with Tierra Biru Viajes to avoid any inconvenience. You must agree to our terms and conditions when making payment through our online payment gateway.
1. The Contract
The contract is entered into between Tierra Biru Viajes, us, and the Client, including all persons named on the booking form. The person signing the booking form warrants that he or she has full authority on behalf of all persons named and confirms that all such persons are aware of and agree to these conditions.
2. Deposit required to confirm a booking
A deposit of USD 300 per person is required to confirm the booking (non-refundable deposit). All flights (domestic and international) must be paid in full in advance to secure seats. Cruise bookings are subject to special deposit policies depending on the ship. If the reservation is made 60 days or less before departure, full payment is required.
3. Full payment and reconfirmation of reservation
Full payment or the balance must be paid between 60 and 45 days before the departure date of the trip. As soon as we receive full payment, we will send you an email confirming your reservation. If the reservation is made 60 days or less before departure, full payment is required. If full payment or the balance is not paid on or before the due date, we reserve the right to consider your reservation cancelled.
4. Cancellation by the Client
Any cancellation by a Client must be made in writing and acknowledged in writing by TIERRA BIRU VIAJES EIRL. The date on which TIERRA BIRU VIAJES EIRL or its travel advisors receive the cancellation request will determine the applicable cancellation fees.
- a) 70 days or more before departure, non-refundable deposit.
- b) 69-31 days; we will retain – 40% of the trip cost.
- c) 30-16 days; we will retain – 70% of the trip cost.
- d) 15 days or less; we will retain – 100% of the trip cost.
Special Remarks
- Payments or deposits for flight reservations are non-refundable due to airline policies.
- In case of postponement of the trip, an administrative fee of 20% of the trip price plus the amount already spent on non-refundable outsourced services will be charged. The remaining amount may be used for future trips with TIERRA BIRU VIAJES EIRL.
- No refund will be made if you voluntarily abandon a trip for any reason after the trip has commenced. Refunds will be made at the discretion of TIERRA BIRU VIAJES if you are involuntarily forced to abandon a trip for any reason. No refunds will be made for unused accommodation, transportation, sightseeing, meals or services.
- It is highly recommended that you take out comprehensive insurance, which includes coverage in certain circumstances against loss of deposit or cancellation fees.
5. Customer Personal Information
In order for TIERRA BIRU VIAJES to confirm and guarantee the Customer’s travel arrangements, the Customer must provide all Customer Details together with their full payment. If the Customer does not provide all details 60 days or more before departure, an administration fee will be charged. In the event that TIERRA BIRU VIAJES has not received the Client’s details 30 days prior to the Client’s departure, TIERRA BIRU VIAJES reserves the right to treat the file as cancelled, and full cancellation charges will apply. The Client details required will vary from trip to trip and will be provided during the booking process. However, as a minimum, the Client details include passport number, passport expiry date, full name as it appears on the passport, date of birth, place of birth, nationality and arrival details (or other documents requested by Tierra Biru Viajes). A booking cannot be confirmed if the Client’s details are not provided.
6. Cancellations and changes by Tierra Biru Viajes
- a) While Tierra Biru Viajes will use its best endeavours to operate all trips as advertised, by entering into this contract the Client accepts that it may be necessary or advisable to vary or modify a trip itinerary or its content due to prevailing local conditions.
- b) Due to unforeseen and unusual circumstances beyond the control of the company, the consequences of which could not have been avoided even with due diligence. The company will use its best endeavours to minimise the effects of matters beyond its control, but cannot accept any liability for such matters, including political disputes, border closures and visa denials, industrial action, delayed flights, unpredictable weather, strikes, war, civil unrest, natural disasters, government action, mechanical failures or any force majeure, among others. Tierra Biru Viajes reserves the right to cancel or change any facilities, services or prices (including flights, accommodation or other arrangements) at any time and substitute alternative arrangements of comparable monetary value without monetary compensation or refund; and accepts no liability for loss of enjoyment as a result of these changes. The client agrees to bear all additional costs arising from any of these factors.
- c) We are not responsible for any additional costs you may incur as a result of your booking, such as visas, vaccinations or non-refundable flights.
7. Methods of payment
- a) We accept VISA, MasterCard, AMEX and Diners Club through this payment method, and no commission is charged.
- b) Bank transfer You can transfer funds directly from your own bank account to ours. This account carries a 50 USD administration fee which you must add to the amount you send. We will send you our account details when you confirm your trip. Duration of transfer to receive: From 1 day to 3 days depending on the place from which you send.
- c) PayPal We accept payments through PayPal; through this payment method, PayPal charges a 5% commission, and you are responsible for paying it. (Example: initial amount of US $ 100 + 5% PayPal commission, you must pay US $ 105).
8. Changes by the Customer
- a) For any changes by the client to the itinerary after receiving a confirmed travel invoice from Tierra Biru Viajes, a change fee of US $ 40 will be charged plus any costs or charges incurred or charged by our suppliers as a result of the modification. Although all reasonable efforts will be made to accommodate changes and additional requests, their availability cannot be guaranteed.
- b) Any changes made by the Client must be made within 45 business days prior to the departure of the trip; Otherwise, Tierra Biru Viajes reserves the right to accept or reject suggested modifications based on the availability of the tour companies: accommodations, tour operators and transportation.
- c) No changes will be accepted for reservations made 44 business days prior to trip departure.
- d) Any modification to the original reservation must be confirmed by the person signing the reservation form.
9. Customer Replacement
If any member of your party is unable to travel, it may be possible to transfer the reservation to another suitable person, provided written notice is given at least 45 days prior to departure. An administrative fee of $50 will be charged plus costs imposed by Tierra Biru Viajes suppliers. For the Inca Trail, it is not possible to change any information such as dates, name and passport number after a permit has been processed. A permit is non-transferable and non-refundable. The deposit will be 100% forfeited. Please note that we do this because we are prohibited from reselling your permit after you cancel it.
10. Medical conditions and special requirements
The Client must notify Tierra Biru Viajes in writing during the booking process of any medical condition, pregnancy, disability or any other mental or physical condition that may affect fitness to travel or any medical condition. Failure to notify Tierra Biru Viajes may result in the Client being refused travel. If Tierra Biru Viajes is not notified of any condition that results in cancellation, the Client will be required to pay the full cancellation fee. Some trips may not be suitable for Clients due to their age, mobility, disability, pregnancy or physical or mental conditions. It is the Client’s responsibility to check this before booking. Tierra Biru Viajes may refuse to transport women who are 24 weeks pregnant or Clients with certain conditions. Tierra Biru Viajes is not obliged to provide special facilities unless it has agreed to do so in writing. Tierra Biru Viajes will make every effort to accommodate Clients’ special requests, including dietary requests, but such requests do not form part of the Contract and Tierra Biru Viajes is therefore not liable for failure to provide them. Medical facilities vary from country to country and Tierra Biru Viajes makes no representation or warranty as to the standard of such treatment.
Travelling with children
Clients who are 18 years of age or older on the date of first travel are considered adults. One adult over 18 years of age must accompany every 2 children under 18 years of age. The ratio between adults and children travelling together must be one adult for every two children and two adults for every four children (aged 17 years or younger). The minimum age for clients travelling on tours is 12 years (for family tours, the minimum age is 5 years). All enquiries regarding children are subject to review and approval by Tierra Biru Viajes, which reserves the right to restrict the number of travellers under the age of 18 on tours.
11. Passport, Visa and Vaccinations
It is the Client’s responsibility to possess a valid passport and carry it throughout their trip to show it at checkpoints required by the destination of visit, visa permits, vaccinations and preventive medications required for the duration of the tour. Information on these or related matters is provided in good faith but without liability on the part of Tierra Biru Viajes.
12. Age, Physical Condition and Participation
- a) All clients are expected to ensure, before booking, that they are fit to undertake the chosen itinerary. Persons over the age of 60 will be advised to obtain medical evidence of their fitness to travel on their chosen itinerary.
- b) Unaccompanied minors under the age of 18 cannot be accepted on trips operated by Tierra Biru Viajes, but older teenagers may be considered if accompanied by a parent or guardian who accepts full responsibility for them.
- c) Tierra Biru Viajes reserves the absolute right to refuse a booking at its discretion. Clients agree to accept the authority and decisions of Tierra Biru Viajes employees, tour guides and travel advisors during the tour with Tierra Biru Viajes.
- d) If, in the opinion of such person, the health or conduct of a Client before or after departure appears to endanger the safe, comfortable or happy conduct of a trip, the Client may be excluded from all or part of the trip. In the event of illness, Tierra Biru Viajes may take such steps as it deems appropriate and claim expenses from the Client.
13. Local legislation
All participants in trips operated by Tierra Biru Viajes are expected to obey the laws and regulations of the countries visited, and any failure to do so will exempt Tierra Biru Viajes from all obligations they may have under these booking conditions.
14. Illness or Disability
Anyone suffering from an illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment that may be necessary during the trip. Failure to do so will constitute a breach of these booking conditions and will result in such persons being excluded from the trip, in which case all monies paid will be forfeited. If the chosen holiday includes any type of excursion or boat transfer, the Client must inform at the time of booking if he or she is unable to swim. This will not prevent the Client from participating in the excursion but will enable Tierra Biru Viajes to take additional precautions for the Client’s safety at appropriate times.
15. Travel Insurance
Travel insurance is required. Tierra Biru Viajes strongly recommends travel insurance for all of our travellers. Your travel insurance must provide coverage for personal accident, death, medical expenses and emergency repatriation with a minimum recommended coverage of US$100,000 for each of the coverages. We also strongly recommend that you cover cancellation, curtailment, personal liability and loss of luggage and personal effects. You will be required to provide proof of your travel insurance 15 days prior to departure of the trip. Special Note: In case you do not consider it necessary or do not need travel insurance, you will be required to sign an affidavit stating that you do not need travel insurance and that you will be responsible in case of any inconvenience during the trip.
16. Flight Reservations
- a) Tierra Biru Viajes will make every effort to ensure that all flight prices are correct at the time they are quoted. Airlines reserve the right to change or withdraw fares without notice. Once a deposit is paid on an airfare, it ensures that a reservation is made for you, but DOES NOT GUARANTEE the fare.
- b) The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued.
- c) Flight reservations are not transferable. Flight schedules provided by Tierra Biru Viajes are merely indicative and are subject to change. Updated flight schedules will be shown on the tickets.
- d) The Client should carefully check the tickets immediately after receiving the final schedules. Tierra Biru Viajes will endeavour to inform the Client as soon as possible in the event of any alterations to flights.
- e) Airline details are also subject to change. Such alterations do not constitute a significant change in the organisation of the trip and therefore do not entitle you to cancellation without paying the normal charges for this.
- f) Tierra Biru Viajes is not responsible for any delay in your flight, whether caused by adverse weather conditions, action by air traffic controllers, airport authorities or (local) governments, rescheduling of flight schedules by the airline, mechanical breakdown, strike, industrial action or any other reason.
17. Client Responsibility
- a) Clients agree to accept the authority and decisions of Tierra Biru Viajes employees, tour leaders and tour advisors while on tour with Tierra Biru Viajes. If, in the opinion of such individuals, the health or conduct of a client at any time before or after departure appears to endanger the safety, comfort or happy progress of a tour, then the client may be excluded from all or part of the tour.
- b) In the event of illness, Tierra Biru Viajes may take such action as it deems appropriate and recover costs from the client. If a client commits an unlawful act, he or she may be excluded from the tour, and Tierra Biru Viajes shall no longer have any liability to him or her. If you are affected by a condition, medical or otherwise, which may affect the enjoyment or active participation in the tour of others, you must inform us at the time of booking.
- c) No refunds will be made for unused services. Clients must be in possession of a passport to show at the checkpoints they are going to visit and are responsible for obtaining a valid passport, visa, if applicable, and vaccination certificates required for the entirety of their trip. Information on or related to these matters (climate, clothing, luggage, etc.) is provided in good faith, but Tierra Biru Viajes is not responsible for it.
18. Tierra Biru Viajes Responsibility.
- a) Tierra Biru Viajes organizes on behalf of our travelers, under their names, transportation, accommodation, meals and other required tourist services. Therefore, we are not responsible in case of accidents, loss of personal belongings during the subcontracting of services such as during the services of the Tour Guide, on the bus, in hotels, in restaurants, during hikes, camping, etc. delays or interference with the tour, due to force majeure for which we have no direct responsibility.
- b) Tierra Biru Viajes is not responsible for illness, maternity, physical or mental disabilities that endanger the health or integrity of the traveler or third parties during the tour. We will not accept any claim or refund for the reasons mentioned above.
- c) Tierra Biru Viajes will not pay any compensation if it is forced to cancel or modify your trip due to war, threat of war, riots, civil conflicts, labor disputes, natural disasters, fires or adverse weather conditions, epidemics or health risks, technical or maintenance problems with transportation, closed or congested airports or ports, changes imposed by airline rescheduling or cancellation of flights, alteration of airlines or types of aircraft, or similar events beyond the control of Tierra Biru Viajes.
- d) Tierra Biru Viajes is not responsible for changes in the flight schedule or departure airport, as this is the responsibility of the airline. However, we will endeavour to minimise their effects on your trip. We cannot accept any liability for delays to any of your flights, whether the cancellation or delay is due to adverse weather conditions, airline rescheduling, action by airport authorities and/or air traffic controllers, mechanical breakdown or industrial action. Where prolonged flight delays result in loss of holiday time, hotels or suppliers do not offer refunds. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavour to reduce the inconvenience resulting from any delay by providing meals and accommodation, as appropriate to the time of day or night (subject to local availability). You make payments for such services in the event of a delay.
19. Financial Security
Tierra Biru Viajes is a travel agency accredited by the Ministry of Tourism of Peru and is a Tour Operator authorized by the Ministry of Foreign Trade of Peru (DIRCETUR), requiring full indemnity insurance and a full bond to comply with all laws related to the international travel business. Our company registration number (RUC) is 20601304253. Tierra Biru Viajes is an official Inca Trail operator with a license accredited by the SERNANP. We are a Local Tour Operator with an office in Cusco, Peru, an Authorized and Licensed Tour Operator by the Ministry of Foreign Trade and Tourism of Peru under TIERRA BIRU VIAJES EIRL Tour Operator; we do not own vehicles, accommodations, hotels, restaurants, etc. Instead, we carefully select local operators in Lima, Arequipa, Puno, Ica, Amazonas, Trujillo, etc., and facilities that we want to work with and trust, based on our 10 years of experience.
20. Photographs and Testimonials
If we capture or take any images of you during the tour, we have the right to use them in our advertising campaigns free of charge. This includes all types of promotional material such as slides, video programs, brochures and the Internet. If you have provided us with any written feedback, this may also be used for promotional purposes.
21. Privacy Policy
The company will use the personal information you provide to us to make all arrangements for the trip. As such, we will need to pass it on to our suppliers and carriers to enable the operations of the services you have requested. However, we will endeavour to protect your information and use it for official purposes only to the extent that it is extremely necessary. I have taken the time to read the Booking Conditions. I have fully understood all the clauses and give my full consent to all of them.
