
Terms and conditions
Please take your time to carefully read and understand our Booking Terms and Conditions detailed below before booking a trip with Tierra Biru Expeditions to avoid any inconvenience. You must accept our terms and conditions when making payment through our online payment gateway.
- The contract
The contract is between Tierra Biru Viajes, us, and the Client, including all persons named on the booking form. The person signing the booking form guarantees that they have full authority on behalf of all named persons and confirms that all such persons are aware of and accept these conditions.
- Deposit required to confirm a booking
A deposit of USD 200 per person is required to confirm a booking (non-refundable). All flights (domestic and international) must be paid in full in advance to secure seats. Cruise reservations are subject to special deposit policies depending on the ship. If the reservation is made 60 days or less before departure, full payment is required.
- Full Payment and Reconfirmation of Reservation
Full payment or the balance is due between 60 and 45 days before the voyage departure date. As soon as we receive full payment, we will send you an email confirming your reservation. If the reservation is made 60 days or less before departure, full payment is required. If full payment or the balance is not paid on or before the due date, we reserve the right to consider your reservation canceled. The amount paid will be used to cover administrative costs.
- Cancellation by the Client
Any cancellation by a Client must be made in writing and validated by TIERRA BIRU VIAJES EIRL. The date TIERRA BIRU VIAJES EIRL or its travel advisors receive the cancellation request will determine the applicable cancellation fees.
a) 70 days or prior to departure, non-refundable deposit.
b) 69-31 days; we will retain 40% of the trip cost.
c) 30-16 days; we will retain 70% of the trip cost.
d) 15 days or less; we will retain 100% of the trip cost.
Note: Some suppliers (hotels, airlines, local operators, public institutions) may apply additional charges or not allow refunds. These terms will prevail over our general policy.
Special Notes.
Payments or deposits for flight reservations are non-refundable due to airline policies. In the event of trip postponement, an administrative fee of 20% of the trip price plus the amount already spent on non-refundable subcontracted services will be charged. The remaining amount may be used for future trips with TIERRA BIRU VIAJES EIRL. No refund will be issued if you voluntarily abandon a trip for any reason after the trip has begun. Refunds will be issued at the discretion of TIERRA BIRU VIAJES if you are involuntarily forced to abandon a trip for any reason. Unused accommodation, transportation, sightseeing, meals, or services will not be reimbursed. It is highly recommended to purchase comprehensive insurance, which includes coverage in certain circumstances against loss of the deposit or cancellation fees. - Customer Personal Information
In order for TIERRA BIRU VIAJES to confirm and guarantee the Customer's travel arrangements, the Customer must provide all Customer Details along with their full payment. If the Customer does not provide all details on or before departure, an administrative fee will be charged. If TIERRA BIRU VIAJES has not received the client's details 30 days prior to the Client's trip departure, TIERRA BIRU VIAJES reserves the right to treat the booking as cancelled, and the full cancellation fees will apply. The required client details will vary from trip to trip and will be communicated during the booking process. However, at a minimum, client details include passport number, passport expiry date, full name as it appears on the passport, date of birth, place of birth, nationality, and arrival details (or other documents requested by Tierra Biru Viajes). A booking cannot be confirmed if the client's details are not provided.
- Cancellations and Changes by Tierra Biru Viajes
a) While Tierra Biru Viajes will endeavor to operate all trips as advertised, by entering into this contract, the Client accepts that it may be necessary or advisable to vary or modify a travel itinerary or its content due to prevailing local conditions.
b) Due to unforeseen and unusual circumstances beyond the company's control, the consequences of which could not have been avoided even with due diligence. The company will endeavor to minimize the effects of matters beyond its control, but cannot accept any liability for these matters, including, but not limited to, political disputes, border closures and visa denials, industrial action, delayed flights, unpredictable weather, strikes, war, civil unrest, natural disasters, government action, mechanical failures, or any other force majeure. Tierra Biru Viajes reserves the right to cancel or amend at any time the facilities, services, or prices (including flights, accommodation, or other provisions) and to replace them with alternative provisions of comparable monetary value without monetary compensation or refund; and accepts no liability for loss of enjoyment resulting from these changes. The customer agrees to assume any additional expenses arising from any of these factors.
c) We are not responsible for any additional expenses you may incur as a result of your booking, such as visas, vaccinations, or non-refundable flights. - Payment Methods
a) We accept VISA, MasterCard, AMEX, and Diners Club through this payment method, and there is no fee.
b) Bank Transfer: You can transfer funds directly from your own bank account to ours. This account incurs a USD 50 administration fee, which must be added to the amount you send. We will send you our account details upon confirming your trip. Transfer time to receive: 1 to 3 days depending on the location you are sending from.
c) PayPal: We accept payments via PayPal; Through this payment method, PayPal charges a 5% fee, and you are responsible for paying it. (Example: initial amount of US$100 + 5% PayPal fee, you must pay US$105). - Changes by the Customer
a) For any changes made by the Customer to the itinerary after receiving a confirmed travel invoice from Tierra Biru Viajes, a change fee of US$40 will be charged plus any costs or fees incurred or charged by our suppliers as a result of the change. Although every reasonable effort will be made to accommodate changes and additional requests, availability cannot be guaranteed.
b) Any changes made by the Customer must be made within 45 business days prior to the trip's departure; Otherwise, Tierra Biru Viajes reserves the right to accept or reject suggested modifications based on the availability of tourism companies: accommodations, tour operators, and transportation.
c) Changes to reservations made 44 business days prior to trip departure will not be accepted.
d) Any modifications to the original reservation must be confirmed by the person signing the reservation form. - Customer Substitutions
If a member of your party is unable to travel, it may be possible to transfer the reservation to another suitable person, provided written notification is given at least 45 days prior to departure. An administrative fee of $50 plus any costs imposed by Tierra Biru Viajes suppliers will be charged. For the Inca Trail, it is not possible to change any information such as dates, name, and passport number after a permit has been processed. A permit is non-transferable and non-refundable. The deposit will be 100% forfeited. Please note that we do this because we are prohibited from reselling your permit after it is cancelled.
- Medical Conditions and Special Requirements
The Client must notify Tierra Biru Viajes in writing during the booking process of any medical condition, pregnancy, disability, or any other mental or physical condition that may affect fitness to travel or any medical condition. Failure to notify Tierra Biru Viajes may result in the Client being denied travel. If Tierra Biru Viajes is not notified of any condition resulting in cancellation, the Client will be required to pay all cancellation fees. Some trips may not be suitable for Clients due to their age, mobility, disability, pregnancy, or physical or mental conditions. It is the Client's responsibility to check this before booking. Tierra Biru Viajes may refuse to transport women who are 24 weeks pregnant or Clients with certain medical conditions. Tierra Biru Viajes is not obliged to provide special accommodations unless it has agreed to do so in writing. Tierra Biru Viajes will make every effort to accommodate Clients' special requests, including dietary requests, but such requests are not part of the Contract and, therefore, Tierra Biru Viajes is not responsible for failing to provide them. Medical facilities vary from country to country, and Tierra Biru Viajes is not responsible for or guarantees the level of such treatment.
Traveling with Children
Clients who are 18 years of age or older on the date of the first trip are considered adults. One adult over 18 must accompany every two children under 18. The ratio of adults to children traveling together must be one adult for every two children and two adults for every four children (17 years of age or younger). The minimum age for clients traveling on excursions is 12 years (for family excursions, the minimum age is 5 years). All inquiries regarding children are subject to the review and approval of Tierra Biru Viajes, which reserves the right to restrict the number of travelers under 18 years of age on trips. - Passport, Visa, and Vaccinations
It is the Client's responsibility to possess a valid passport and carry it throughout their trip to show it at checkpoints required by the destination, visa permits, vaccinations, and preventive medications required for the duration of the tour. Information on these or related matters is provided in good faith but without liability on the part of Tierra Biru Viajes.
- Age, Physical Condition, and Participation
a) All clients are expected to ensure, before booking, that they are fit to undertake the chosen itinerary. Persons over 60 years of age are advised to obtain medical evidence of their fitness to travel on the chosen itinerary.
b) Unaccompanied minors under 18 years of age cannot be accepted on tours operated by Tierra Biru Viajes, but older teenagers may be considered if accompanied by a parent or guardian who accepts full responsibility for them.
c) Tierra Biru Viajes reserves the absolute right to refuse a booking at its discretion. Clients agree to accept the authority and decisions of Tierra Biru Viajes employees, tour guides, and travel advisors during the tour with Tierra Biru Viajes.
d) If, in the opinion of such a person, a Client's health or conduct before or after departure appears to jeopardize the safe, comfortable, or happy conduct of a trip, the Client may be excluded from all or part of the trip. In the event of illness, Tierra Biru Viajes may take whatever measures it deems appropriate and claim expenses from the Client. - Local Law
All participants on trips operated by Tierra Biru Viajes are expected to obey the laws and regulations of the countries visited, and any failure to do so will release Tierra Biru Viajes from all obligations they may have under these booking conditions.
- Illness or Disability
Any person suffering from an illness or disability, or undergoing treatment for any physical or medical condition, must declare the true nature of that condition at the time of booking and make arrangements for the provision of any medication or other treatment that may be required during the trip. Failure to do so will constitute a breach of these booking conditions and will result in the exclusion of such person from the trip, in which case all monies paid will be forfeited. If the chosen vacation includes any type of excursion or boat transfer, the Client must inform the Client at the time of booking if they are unable to swim. This will not prevent the Client from participating in the excursion, but will allow Tierra Biru Viajes to take additional precautions for the Client's safety at appropriate times.
- Travel Insurance
Travel insurance is required. Tierra Biru Viajes strongly recommends travel insurance for all our travelers. Your travel insurance must provide coverage for personal accident, death, medical expenses, and emergency repatriation, with a recommended minimum coverage of US$100,000 for each coverage. We also strongly recommend coverage for cancellation, curtailment, personal liability, and loss of baggage and personal belongings. You must provide proof of your travel insurance 15 days prior to your trip's departure. Special Note: If you do not consider it necessary or do not require travel insurance, you must sign a sworn statement stating that you do not require travel insurance and that you will be responsible for any incidents during your trip.
- Flight Reservations
a) Tierra Biru Viajes will make every effort to ensure that all flight prices are correct at the time they are quoted. Airlines reserve the right to change or withdraw fares without prior notice. Once a deposit is paid on an airfare, it ensures that a reservation is made for you, but it DOES NOT GUARANTEE the fare.
b) The fare can only be guaranteed when the flight reservation has been paid in full and a ticket has been issued.
c) Flight reservations are non-transferable. The flight schedules provided by Tierra Biru Viajes are merely indicative and subject to change. Updated flight schedules will be shown on the tickets.
d) The Customer should carefully check the tickets immediately after receiving the final schedules. Tierra Biru Viajes will endeavor to inform the Customer as soon as possible in the event of any flight disruptions.
e) Airline details are also subject to change. Such alterations do not constitute a significant change in the travel arrangements and, therefore, do not entitle you to cancellation without paying the normal cancellation charges.
f) Tierra Biru Viajes is not responsible for any delays to your flight, whether caused by adverse weather conditions, actions of air traffic controllers, airport authorities or (local) governments, rescheduling of flight schedules by the airline, mechanical breakdown, strike, industrial action or any other reason. - Customer Responsibility
a) Customers agree to accept the authority and decisions of Tierra Biru Viajes employees, tour leaders, and travel advisors while on tour with Tierra Biru Viajes. If, in the opinion of such individuals, a customer's health or conduct at any time before or after departure appears to jeopardize the safety, comfort, or successful progress of a trip, then the customer may be excluded from all or part of the trip.
b) In the event of illness, Tierra Biru Viajes may make whatever arrangements it deems appropriate and recover costs from the customer. If a customer commits an illegal act, they may be excluded from the trip, and Tierra Biru Viajes will no longer have any responsibility for them. If they are affected by a condition, medical or otherwise, that may affect the enjoyment or active participation of others in the tour, they must inform us at the time of booking.
c) No refunds will be made for unused services. Clients must have a passport to show at the checkpoints they will visit and are responsible for obtaining a valid passport, a visa, if applicable, and the necessary vaccination certificates for their entire trip. Information on these or related matters (weather, clothing, luggage, etc.) is provided in good faith, but Tierra Biru Viajes is not responsible for it. - Tierra Biru Viajes Responsibility.
a) Tierra Biru Viajes arranges on behalf of our travelers, under their names, transportation, accommodations, meals, and other required tourist services. Therefore, we are not responsible in the event of accidents or loss of personal belongings during the subcontracting of services, such as during the services of a Tour Guide, on the bus, in hotels, in restaurants, during hikes, camping, etc. Delays or interference with the tour due to force majeure for which we have no direct responsibility.
b) Tierra Biru Viajes is not responsible for illness, maternity, or physical or mental disabilities that endanger the health or well-being of the traveler or third parties during the tour. We will not accept any claims or reimbursements for the aforementioned reasons.
c) Tierra Biru Viajes will not pay any compensation if it is forced to cancel or modify your trip due to war, threat of war, riots, civil strife, labor disputes, natural disasters, fires or adverse weather conditions, epidemics or health risks, technical or maintenance problems with transportation, closed or congested airports or ports, changes imposed by airline rescheduling or flight cancellations, alteration of airlines or aircraft types, or similar events beyond the control of Tierra Biru Viajes.
d) Tierra Biru Viajes is not responsible for changes in flight schedule or departure airport, as this is the responsibility of the airline. However, we will endeavor to minimize their impact on your trip. We cannot accept any liability for delays to any of your flights, whether the cancellation or delay is due to adverse weather conditions, airline rescheduling, action by airport authorities and/or air traffic controllers, mechanical breakdown, or industrial action. When extended flight delays result in the loss of vacation time, hotels or suppliers do not offer refunds. Similarly, airlines do not offer compensation for flight delays. However, at their discretion, carriers will endeavor to minimize the inconvenience caused by any delay by providing meals and accommodation, as appropriate for the time of day or night (subject to local availability). If you make payments for such services in the event of a delay. - Financial Security
Tierra Biru Viajes is a travel agency accredited by the Peruvian Ministry of Tourism and is an authorized Tour Operator by the Peruvian Ministry of Foreign Trade (DIRCETUR), requiring full indemnity insurance and a full surety bond to comply with all laws related to the international travel business. Our company registration number (RUC) is 20601304253. Tierra Biru Viajes is an official Inca Trail operator with a license accredited by SERNANP. We are a Local Tour Operator with an office in Cusco, Peru, an Authorized and Licensed Tour Operator by the Peruvian Ministry of Foreign Trade and Tourism under TIERRA BIRU VIAJES EIRL Tour Operator; we do not own vehicles, accommodations, hotels, restaurants, etc. Instead, we carefully select local operators in Lima, Arequipa, Puno, Ica, Amazonas, Trujillo, etc., and the facilities we want to work with and trust, based on our 10 years of experience.
- Photographs and Testimonials
If we capture or take any images of you during the tour, we have the right to use them in our advertising campaigns free of charge. This includes all types of promotional materials, such as slides, video programs, brochures, and the internet. If you have provided us with any written comments, they may also be used for promotional purposes.
- Privacy Policy
The company will use the personal information you provide to make all travel arrangements. As such, we will need to share it with our suppliers and carriers to enable the operation of the services you have requested. However, we will endeavor to protect your information and use it for official purposes only to the extent absolutely necessary. I have taken sufficient time to read the Booking Conditions. I have fully understood all the clauses and give my full consent to all of them.
